We only deliver through specialized brokers. If you place an order directly through our webshop, this order will be delivered to you at all times by one of our dealers.


Article 1. Applicability

1.1 All offers, orders and agreements of Dynamic Ergonomics BV are subject to the exclusion of any other general terms and conditions, these General Terms and Conditions (hereinafter: terms and conditions).

1.2 Accepting an offer or placing an order means that you accept the applicability of these conditions.

1.3 The provisions of these terms and conditions can only be deviated from in writing, in which case the remaining provisions will remain fully in force.

1.4 All rights and claims, as stipulated in these conditions and in any further agreements for the benefit of Dynamic Ergonomics BV, are also stipulated for the benefit of intermediaries and other third parties engaged by Dynamic Ergonomics BV.

Article 2. Offers/agreements

2.1 All offers made by Dynamic Ergonomics BV are without obligation and Dynamic Ergonomics BV expressly reserves the right to change prices, in particular when this is necessary on the basis of (legal) regulations.

2.2 An agreement is only concluded after acceptance of your order by Dynamic Ergonomics BV. Dynamic Ergonomics BV is entitled to refuse orders or to attach certain conditions to the delivery, unless explicitly stated otherwise. If an order is not accepted, Dynamic Ergonomics BV will inform you of this within ten (10) working days after receiving the order.

Article 3. Prices and payments

3.1 The prices for the products and services offered are in euros, excluding VAT and excluding handling and shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing.

3.2 Payment must be made without discount or compensation. The goods will be delivered after the full invoice amount has been paid to the account number that appears during the ordering process.

3.3 Payment can be made in (one of) the way (s) as indicated during the ordering process.

3.4 If the prices for the products and services offered increase in the period between the order and the execution thereof, you are entitled to cancel the order.

Article 4. Delivery

4.1 The delivery times specified by Dynamic Ergonomics BV are only indicative. Exceeding any delivery period does not entitle you to compensation or the right to cancel your order or to dissolve the agreement, unless the delivery period is exceeded in such a way that you cannot reasonably be expected to uphold the agreement. In that case you are entitled to cancel the order or terminate the agreement to the extent that this is necessary.

4.2 The delivery of the products takes place at the moment and time when the products are ready for shipment to you.

Article 5. Retention of title

5.1 The ownership of delivered products will only transfer if you have paid everything you owe Dynamic Ergonomics BV on the basis of any agreement. The risk with regard to the products is transferred to you at the time of delivery.


Article 6. Commercials and liability

6.1 You have the obligation to examine on delivery whether the products meet the agreement. If this is not the case, you must notify Dynamic Ergonomics BV of this in writing and with reasons, as soon as possible and in any case within seven (7) working days after delivery, or at least after observation was reasonably possible.

6.2 If it is demonstrated that the products do not comply with the agreement, Dynamic Ergonomics BV has the choice to replace the products concerned with new products or to refund the invoice value thereof.

Article 7. Ordering/communication

7.1 For misunderstanding, mutilation, delays or improper transmission of orders and communications as a result of the use of the internet or any other means of communication in traffic between you and Dynamic Ergonomics BV, or between Dynamic Ergonomics BV and third parties, insofar as these relate to the relationship between you and Dynamic Ergonomics BV, Dynamic Ergonomics BV is not liable, unless and insofar as there is intent or gross negligence on the part of Dynamic Ergonomics BV.

Article 8. Force majeure

8.1 Without prejudice to the other rights it is entitled to, Dynamic Ergonomics BV has the right, in its own choice, to suspend the execution of your order or to dissolve the agreement without judicial intervention, this by you in writing. to share and this without Dynamic Ergonomics BV being obliged to pay any compensation, unless this would be unacceptable in the given circumstances by standards of reasonableness and fairness.

8.2Force majeure means any shortcoming that cannot be attributed to Dynamic Ergonomics BV, because it is not due to its fault and is not for its account under the Act, legal act or generally accepted beliefs.

Article 9. Miscellaneous

9.1 If you submit a written address to Dynamic Ergonomics BV of an address, Dynamic Ergonomics BV is entitled to send all orders to that address, unless you submit a written address to Dynamic Ergonomics BV of another address to which your orders must be sent.

9.2 If Dynamic Ergonomics BV allows deviations from these Terms and Conditions, whether or not tacitly for a short or longer period of time, this does not affect its right to demand immediate and strict compliance with these Terms and Conditions. You can never assert any rights based on the fact that Dynamic Ergonomics BV applies these Conditions smoothly.

9.3 If one or more of the provisions of these Terms and Conditions or any other agreement with Dynamic Ergonomics BV should conflict with any applicable legal provision, the relevant provision will lapse and be replaced by a new one to be determined by Dynamic Ergonomics BV legally permissible comparable provision.

9.4 Dynamic Ergonomics BV is authorized to make use of third parties in the execution of your order (s).

Article 10. Applicable law and competent court

10.1  All rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions, are exclusively governed by Dutch law.

10.2  All disputes between parties will be submitted exclusively to the competent court in the Netherlands.
